Skilled Migration-190 &491 State Nomination Criteria
New South Wales
Onshore candidates
If you are residing onshore, you must:
- be currently residing in NSW and either:
- have genuinely and continuously resided in NSW for the past three months, or
- be gainfully employed in a long-term capacity in NSW in your nominated (or closely related) occupation for a minimum 20 hours per week
Offshore candidates
If you are residing offshore, you must:
- have continuously resided offshore for the past three months, and
- have a valid skills assessmentlaunch for an occupation within an ANZSCO unit group that accepts offshore candidates —these unit groups are identified with a tick (✔) under the ‘Offshore’ column on our NSW skilled occupation lists page
You must have a minimum three years work experience in your nominated (or closely related) occupation for all occupations within some ANZSCO unit groups — these unit groups are identified with a tick (✔) under the ‘Experience’ column on our NSW skilled occupation lists page.
This applies to all SkillSelect EOIs regardless of when they were submitted or amended.
Note: your three years work experience must be deemed skilled employment. See our Common questions about skilled visas page for information about what employment you are eligible to claim for the purpose of NSW nomination.
You must meet all criteria in one of the following three nomination streams to be eligible for NSW nomination:
Stream 1- I am living and working in Regional NSW
To be eligible under Stream 1 you must:
hold a valid skills assessment for an occupation that appears on the Stream 1 combined occupation list
have been living and working in your nominated (or closely related) occupation in a designated regional area of NSW for the past twelve months for a minimum 20 hours per week
Stream 2- I have recently completed study in Regional NSW
To be eligible under Stream 2 you must:
- hold a valid skills assessment for an occupation that appears on your preferred region’s occupation list
- have completed study in the past 24 months where:
- you are eligible to claim points for ‘study in regional Australia’ on the basis of study in Regional NSW, and
- your qualification is assessed as closely related to your nominated occupation by the relevant assessing authority
Stream 3- I am skilled in an occupation required Regional NSW
To be eligible under Stream 3 you must:
- hold a valid skills assessment for an occupation that appears on your preferred region’s occupation list
- You may only submit one ROI per submission window. Submitting more than one ROI during a submission window – including for a different occupation or preferred region – will automatically remove you from consideration.
- ROIs cannot be amended or withdrawn after they are submitted for any reason. When you submit your ROI during the submission window does not affect your likelihood of being invited to apply. Do not submit your ROI early within the submission window if your circumstances are likely to change before then end of January.
- Do not submit an ROI if you do not intend to apply for nomination. If you are invited to apply for nomination, or have an application declined, you will become ineligible to submit a new ROI for a minimum period of 12 months.
- Submitting an ROI under Stream 1 does not guarantee you will be invited to apply. Because of exceptionally high demand, many people eligible under Stream 1 will not be invited to apply. We strongly recommend all people submitting an ROI pursue all other migration pathways available to them and do not wait to be invited to apply.
- NSW will not prioritise your ROI for any reason. Do not contact our office seeking special consideration of your ROI.
Victoria
To be selected to apply for skilled visa nomination, you must be currently working in one of our target sectors using your STEMM skills.
Applicants using their STEMM skills in a business precinct will be highly regarded. Examples of business precincts are:
Health
The health sector in Victoria consists of professionals providing medical services to Victorians as well as those involved in related education and research and development.
You do not necessarily need to be working in a health occupation (e.g. Nurse) to be considered working in the health sector. For example, a software developer working on software for hospitals is considered to be working in the health sector.
Nursing and allied health applicants: please note that we prioritise applicants with specific specialisations.
Medical Research
In addition to medical research conducted in universities and research institutes, Victoria’s medical research includes activities such as drug development, clinical trials, health product manufacturing, medical devices and digital health.
If you are using your STEMM skills to support medical research in Victoria, you are considered to be working in the medical research sector.
Life Science
Victoria’s life sciences sector is composed of many industries such as the medical technology, biotechnology and pharmaceutical industries. Companies involved in food processing, nutraceuticals and cosmeceuticals may also be considered to form part of the life sciences sector.
If you are using your STEMM skills to support Victoria’s life sciences sector, you are considered to be working in the life sciences sector. For example, a lecturer in biotechnology working in a university is considered to be working in life sciences.
Digital
The digital sector makes use of technology and innovation to drive economic growth, productivity and competitiveness in Victoria.
Subclass 190
To be selected to apply for subclass 190 nomination in the digital sector, you must be working in one of the focus segments below:
- AgriTech
- Artificial intelligence
- Cyber security
- Digital games
- EduTech
- Energy and resources tech
- FinTech
- GPS imaging and geospatial
- Health and medtech
- Robotics and automation
- Smart cities and infrastructure tech
- Transport tech
Applicants who aren’t working in one of the segments above may still be selected if they are using their digital skills in another target sector. For example, a software engineer working in medical research.
Subclass 491
Applicants working in any segment of the digital sector will be considered for selection for subclass 491 visa nomination.
Agri-food
The agri-food sector in Victoria includes highly skilled people working to develop food growth and production as well as the modernisation of Victoria’s agri-food sector. To be considered for selection to apply for nomination, applicants must be using their STEMM skills to innovate within the sector, which could include research and development or advanced manufacturing.
Advanced Manufacturing
Victoria’s advanced manufacturing sector includes industries such as defence and aerospace. To be considered to be working in advanced manufacturing, you must be using your STEMM skills to enhance innovation. This could include activities such as research and development, design, supply chain management increasing global competitiveness through the use of technology.
New Energy, Emissions Reduction and Circular Economy
This sector includes industries such as clean energy, renewables, bioenergy, carbon capture and energy storage. Applicants could be using their STEMM skills to support efforts to reduce waste, cut pollution and protect the environment.
Creative Industries
The creative industries play an important role in Victoria’s cultural life, economic prosperity and social well-being. The Victorian Government’s Creative State 2025 strategyexternal link is designed to secure Victoria’s reputation as a global cultural destination.
To further support this strategy, Victoria is seeking applicants working in the screen industry using their STEMM skills in visual effects or digital animation.
The Skilled Nominated visa (subclass 190) is a permanent visa for skilled migrants with advanced talent currently working in Victoria. You must receive nomination from Victoria before you can apply for the visa.
Employment
- You must be currently working in Victoria in a target sector.
- We will accept casual employment.
- We will accept employment in a role that is closely related to your nominated occupation.
- We will NOT accept employment that is NOT related to your nominated occupation.
- For example, we will not accept situations where you are working as a Personal Care Assistant and your nominated occupation is Software Developer.
- You must support all your claims of employment with documents in your application.
- You will be required to provide a current contract, most recent payslip and an extract from your superannuation account showing the most recent payments from your employer.
- In some instances, we may also require additional payslips or reference letter from your employer. If so, we will ask for this during assessment.
Victorian target sectors
You must be working in one of the following target sectors:
- Health
- Medical research
- Life sciences
- Agri-food
- Advanced manufacturing
- New energy, emissions reduction and circular economy
- Digital

Occupation
Any occupation on the Department of Home Affairs skilled occupation listsexternal link is eligible to submit a Registration of Interest, provided you are using your STEMM skills in one of the target sectors listed above.
We are currently selecting the following occupations with advanced skills:
- ANZSCO skill levels 1 and 2external link, and
- STEMM skills or qualifications.
Skills assessment
- Your nominated occupation in your skills assessmentexternal link must match the ROI, nomination application and EOI.
- When you submit your nomination application your Skills Assessment must have at least 12 weeks validity remaining.
For nurses and allied health

Registration of Interest
- Your Registration of Interest (ROI) must be selected by us before you can apply for skilled visa nomination.
- If you have submitted a ROI but have not received an email inviting you to apply for Victorian nomination, you cannot apply.
- There is no guarantee that your ROI will be selected. View our Registration of Interest page for more information on our selection considerations.
Living in Victoria
- You must be currently living in Victoria.
- You may be required to show evidence of a lease, bond receipt, utilities or other documents that prove you are currently living in Victoria.
- If this is required, we will ask for it during assessment.
- If you live in a border community, you may be eligible if you can clearly demonstrate that you either live or work in Victoria. You must also be able to demonstrate how your skills benefit Victoria.
Age
- You must be under 45 years of age at the time of nomination.
English language
- You must have at least Competent Englishexternal link.
- When you submit your nomination application, your English test must have at least 12 weeks validity remaining.
Points
- You must have at least 65 points, including the 5 points for state and territory nomination.
PhD candidates and graduates from Australian universities
You must meet the eligibility requirements to be considered for selection. This includes living and working in Victoria.
We will not consider you as employed if you are receiving a scholarship or undertaking a professional placement as part of completing your qualification.
Withdrawal
You can withdraw your subclass 190 application at any stage. Please Contact Us to withdraw your application.
For Registrations of Interest (ROI), you must withdraw your ROI using the Live in Melbourne portal only.
Nomination application fees
The Victorian Government does not charge any application fees for nomination.
Nomination refusals
If your application is refused, you will not be able to submit a new application for the same subclass for 6 months. This is to prevent repeat and low quality applications.
You will be able to submit a new application for a different subclass if your Registration of Interest (ROI) is selected.
Review of nomination decision
If you have been refused as you did not meet the eligibility requirements, you cannot request a review of your application.
If you believe that an error was made in assessing your nomination application, you can submit a request for us to review the application.
Renomination
We do not provide renomination in the following instances:
- You do not submit your visa application within 60 days.
- Your EOI was incorrect when we nominated you.
- Your English test or skills assessment has expired.
- If any of the above apply to you, you must submit a new ROI and be selected to apply for nomination again.
The Skilled Work Regional (Provisional) visa (subclass 491) allows skilled migrants to live, study and work in designated regional areasexternal link for a period of 5 years. You must receive nomination from Victoria before you can apply for the visa.
Employment
- You must be currently working in regional Victoria in a target sector.
- We will accept casual employment.
- We will accept employment in a role that is closely related to your nominated occupation.
- We will NOT accept employment that is NOT related to your nominated occupation.

South Australia
1. Residency Requirements
1.1 State nomination is provided to meet the State’s skills needs and is granted based on the applicant’s genuine interest and intention to live and work in South Australia. In submitting your application you are indicating that you intend to live and work in South Australia with a view to long-term settlement.
1.2 If you are in Australia but not currently residing in South Australia, you can only apply through the Talent & Innovators Employment stream.
1.3 If you are currently residing offshore, check South Australia’s Skilled Occupation List to see if your occupation is available to offshore applicants. Eligible offshore applicants must submit a Registration of Interest (ROI) application
2. Age
You must be under age 45 at time of nomination.
3. Occupation
You must have an occupation on South Australia’s Skilled Occupation List and meet the eligibility requirements for that occupation.
4. Skills Assessment
4.1 You must have a valid and positive General Skilled Migration skills assessment from the relevant authority. Skills assessments must be for your nominated occupation. Refer to the Department of Home Affairs for more information on skills assessments.
4.2 Skills assessments must have been issued within the last three years or if the skills assessing authority has specified a shorter validity period, the skills assessment is only valid until that specified date. The skills assessment must be valid at time of nomination decision.
5. Work experience
5.1 You must meet work experience requirement listed for your occupation.
5.2 Skilled work experience must be undertaken post-course completion and is defined as a minimum of 20 hours per week or 40 hours per fortnight of paid employment in your nominated or closely related occupation (some concessions apply if you are currently working in outer regional South Australia, or you are a long-term resident of South Australia, or for specified occupations). Applicants already working in South Australia and South Australian graduates may be eligible for exemptions or waivers to the work experience requirement, as specified in the occupation requirements.
5.3 For South Australian work experience, the employer must have a demonstrable presence in South Australia. Where the employer is located outside of South Australia, applicants must apply though the Talent and Innovator program. Work experience performed at a residential address or shared office space for a company located outside of South Australia will be assessed on a case by case basis.
6. English
6.1 You must meet minimum English language requirement listed for your occupation. Refer to the Department of Home Affairs for more information on English tests.
6.2 If you are currently working in a skilled occupation in South Australia, you are required to have at least competent English unless your nominated occupation requires registration or licensing to practice in South Australia (see 6.4).
6.3 Some skills assessing authorities may have higher English language requirements that you will be required to meet. Please check with your skills assessing authority prior to applying.
6.4 If your occupation requires registration or licensing in South Australia, you will need to ensure you meet the English requirement set by the registration or licensing authority to work in South Australia. Occupations with registration requirements include trades, education and health professions. If higher English requirements are listed for your occupation on South Australia’s Skilled Occupation List, you do not need to meet the higher requirement if you are currently registered to practice in South Australia.
6.5 If you are a passport holder or citizen of the United States, United Kingdom, Ireland, Canada or New Zealand, you do not need to provide an English test result.
7. Points
7.1 You must meet minimum points requirement listed for your occupation (including state nomination points).
7.2 You will need to ensure you meet all Department of Home Affairs requirements and have documented evidence to support your points claim.
8. Available Nomination Streams
- Talent and Innovators Program
- Currently working in South Australia (including long-term resident of SA)
- International Graduate of South Australia
There are concessions and waivers available and eligibility will be primarily dependent on:
- How long you have been residing and working in South Australia.
- Your nominated occupation
- If you are living and working in outer regional South Australia
Currently Living and Working in South Australia
If you have been living and working in South Australia, you are encouraged to consider applying for state nomination.
You must be working at least 20 hours per week or 40 hours per fortnight in your nominated or closely related occupation in South Australia for the duration required for your nominated occupation, unless specified differently for your occupation. If you are working part time (less than 35 hours per week) you may be offered a 491 nomination only.
Closely related occupation is defined as within the ANZSCO 2-digit level. Where specified for your nomination occupation, other occupations may also be considered closely related. A skilled occupation in the same industry as your nominated occupation may also be considered as a closely related occupation.
If you are applying for subclass 491 nomination, you must be currently working for the last 6 months in South Australia, unless specified differently for your occupation.
If you are applying for subclass 190 nomination, you must be currently working for the last 12 months in South Australia, unless specified differently for your occupation.
You must meet the Department of Home Affairs requirements for the 491 or 190 visa subclasses
You must meet the state nomination requirements and the specific requirements listed for your nominated occupation.
If you are a 457, 482 or 494 visa holder with more than 12 months remaining on your visa, you must provide a letter from your current employer consenting to your state nomination application.
Living and Working in regional South Australia
Concessions to the work experience requirements are available for applicants who are living and working in outer regional South Australia.
To be considered to be working in outer regional South Australia, you must be employed and residing in an area outside of Greater Adelaide. View the full list of eligible postcodes.
If you are living and working in outer regional South Australia, you may be eligible for the following concessions to the skilled work experience requirements.
- If you are currently residing and working for the last 12 months in outer regional South Australia in any occupation (does not have to be a skilled occupation nor related to your nominated occupation) you may be eligible to be nominated for a 491 visa nomination.
If you are currently residing and working for the last 24 months in outer regional South Australia in any occupation (does not have to be a skilled occupation nor related to your nominated occupation) you may be eligible to be nominated for 190 visa nomination.
If you are currently residing and working in outer regional South Australia and you are unable to meet the requirements above, you can still submit a Registration of Interest for the Talent and Innovators program.
Living an working in SA as a long-term resident
Long-term residents who are living and working in SA in other skilled occupations.
If you are not working in your nominated or closely related occupation, but you are working in other skilled occupations, you may be eligible for state nomination.
Prospective applicants who are working in their nominated or closely related occupation are invited to apply through the standard program or the Talent and Innovators program.
Option One: International Graduates and Partners
- If you are a former international graduate of South Australia or a partner of an international graduate of South Australia, currently residing in South Australia you may be eligible for subclass 491 nomination, if:
- You have resided continuously in South Australia (at time of state nomination application) for the last 3 years
- You are currently working for the last 12 months in South Australia in a skilled occupation that is not your nominated occupation, including all Skill Level 1, 2, 3 occupations and Skill Level 4 Carers and Aides occupations
- While you must be currently working in a skilled occupation in SA, your 12 months skilled work experience can be gained over the last 3 years
- Your 12 months skilled work experience in South Australia must be at least 20 hours per week or 40 hours per fortnight
- If you have recently commenced working in your nominated or closely related occupation, but have 12 months of work experience in other skilled occupations, you are still eligible to apply
- Lower skilled occupations such as cleaners, drivers, kitchenhands are not eligible
- Applicants working as massage therapists must be working in a hospital, aged or disability care setting or an allied healthcare setting, such as a physiotherapy clinic
- Applicants are generally eligible for a 491 nomination only. A 190 nomination will be considered on a discretionary basis if you are are earning at least $80,000 per annum and working full-time in highly skilled position.
Option Two: Other temporary visa holders
- You have resided continuously in South Australia (at time of state nomination application) for the last 5 years
- You are currently working for the last 12 months in South Australia in a skilled occupation that is not your nominated occupation, including all Skill Level 1, 2, 3 occupations and Skill Level 4 Carers and Aides occupations
- Your 12 months skilled work experience in South Australia must be at least 20 hours per week or 40 hours per fortnight
- Lower skilled occupations such as cleaners, drivers, kitchenhands are not eligible
- Applicants working as massage therapists must be working in a hospital, aged or disability care setting or an allied healthcare setting, such as a physiotherapy clinic
- Applicants are eligible for a 491 nomination only
Option Three: Safe Haven Enterprise visa holders
- You have resided in South Australia for at least 5 years (at time of state nomination application) and continue to reside in South Australia
- You must be currently working for the last 12 months in South Australia in any occupation (does not have to be a skilled occupation or related to your nominated occupation)
- Your 12 months work experience in South Australia must be at least 20 hours per week or 40 hours per fortnight
- Applicants are eligible for a 491 nomination only
The Talent and Innovators program allows the state to nominate applicants under one of the following five streams.
Employment stream: For highly skilled migrants who are working for South Australian businesses
Outer Regional South Australia workforce stream: For skilled applicants working for outer regional South Australian businesses (who do not qualify to apply directly for state nomination but wish to provide a submission for consideration)
Start up and small business stream: For entrepreneurial skilled migrants who have started their own business in South Australia
High performing graduate stream: For high performing graduates who have completed their qualification at a South Australian higher education institution
Independent talent stream: For high calibre applicants seeking state nomination
All occupations eligible for migration through state-nomination are available through the Talent and Innovators program. Successful applicants will demonstrate how they bring new ideas, skills and innovation to South Australia and can create local jobs.
Prospective applicants who meet the guidelines below for the Talent and Innovators program are encouraged to submit an Registration of Interest via the Skilled & Business Migration portal.
Upon review of your Registration of Interest, you may be invited to submit an online application form for state nomination. All registrations of interest through the Talent and Innovators program are considered on a case-by-case basis. This page provides an indicative guide for each Talent and Innovators stream and an invitation to apply for state nomination is not guaranteed even if you meet the guidelines (see Terms & Conditions).

All applicants must meet the state nomination requirements and the Department of Home Affairs requirements for the subclass 491 or subclass 190 visa.
The Talent and Innovators program is currently unavailable to applicants applying from offshore.
The Talent and Innovators Employment stream is available to applicants in Australia. All other Talent and Innovator streams are only available to applicants residing in South Australia.

start-up companies may be exempt from the annual turnover requirement
businesses who operate in outer regional South Australia may be exempt from the annual turnover requirement
- Be a business of good standing and there must be no adverse information about the business.
As the applicant:
You must be earning a high base salary threshold commensurate with the expectations of the talent program (at least $80,000 full time). An exemption to the salary threshold may be available for highly skilled applicants who are:
working for a start-up
working for a business in outer regional South Australia
a recent graduate
- If you are in South Australia, you must be on an existing temporary visa and working for business already

Outer Regional South Australia Workforce Stream
For skilled migrants working for outer regional South Australian businesses who wish to provide a submission for consideration.

Be an existing business for at least 12 months, and have a premise located and operating in outer regional South Australia for the last 12 months.
Be a business of good standing and there must be no adverse information about the business.
As the applicant:
You must be in South Australia on an existing temporary visa, and already commenced working for the business already
You are unable to meet the published requirements and wish to submit a registration of interest for consideration. Reasons for being unable to meet the published requirements include, but is not limited to; visa expiry, losing points for age, document expiry, or working less than 20 hours per week or 40 hours per fortnight.
You should include a letter of support from your employer and a submission outlining why you should be considered for nomination. Registrations of interest will be considered on a case by case basis.
Start-up and small business stream
For entrepreneurial skilled migrants who have started their own business
Eligibility guidelines with demonstrated evidence includes: (this is an indicative guide, you can submit a registration of interest for consideration if you are close to meeting the guidelines)
Your business must be established in South Australia and operating in South Australia for the last 12 months and you must have resided in South Australia for at least the last 24 months
If you are an existing SISA visa holder you must have an established business in South Australia for the last 6 months and resided in South Australia continuously during this time
Your business must be able to give you a personal income that would meet the minimum taxable income requirement set by the Department of Home Affairs
Businesses aligning with the priority growth industries will be favoured
Businesses employing at least two employees (other than the applicant) on an ongoing full-time basis will be prioritised
You must provide a business case (maximum 2 pages) with:
- evidence of thorough research into, and understanding of the relevant industry conditions in South Australia
how the business will be innovative, contribute to South Australia’s economic growth and can support job creation for South Australians.
how the applicant’s previous experience and qualifications will help the applicant successfully build their business in South Australia over at least 3 years
- Self employed applicants and sub contractors must apply through this stream. This includes applicants working for businesses in which they have some shares, partly own, or owned by their partners

High Performing graduate stream
For high performing graduates who have completed their qualification at a South Australian higher education institution.

If you are living overseas and want to apply for ACT nomination for a Skilled Nominated Visa (subclass 190) you must meet certain criteria at the date you submit the Canberra Matrix.

- You are working full time in your nominated occupation.
- You hold the relevant Australian registration or licencing if it is required for your nominated occupation.

- must be a medium to large Australian enterprise (50 plus employees) actively trading in Canberra.
- cannot be trading from a home, online or serviced office.
- must have a genuine need to employ an overseas skilled worker.
- must demonstrate that the position is relevant to the business; and cannot be filled from the local labour market.
- Employer statutory declaration: your ACT employer MUST declare that:
- you will be employed in a genuine position in Canberra in accordance with Australian legislation.
- the position is relevant to the operations of the business.
- the minimum period of employment is for at least two years.
- they have tested the labour market and are unable to find an Australian Citizen or permanent resident to fill the position.
- English: You meet the Department of Home Affairs requirement for ‘proficient’ or ‘superior’ English; or you hold a valid passport issued by the United Kingdom, the United States of America, Canada, New Zealand or the Republic of Ireland.
- Spouse / partner:
- If you wish to claim Matrix points for a spouse / partner, you must have proof of the relationship; either a marriage certificate or a civil partnership/union certificate. The ACT does not accept a claim of a defacto relationship.
- If you wish to claim Matrix points in the spouse / partner employment category, your spouse / partner must meet the Department of Home Affairs requirement for ‘competent’ English; or hold an Australian passport.

If you are living overseas and you want to apply for ACT nomination for a Skilled Regional Work Visa (subclass 491), you must meet certain criteria at the date you submit the Canberra Matrix. These include the following.
- Nominated occupation: Your nominated occupation is on the latest ACT Critical Skills List.
- You are working full time in your nominated occupation.
- Relevant overseas work experience:
- You have at least three years full time, post graduate work experience in your nominated occupation. The work experience must be assessed as relevant by the assessing body (if the points advice service is provided by the assessing body).
- Your skills and experience in the nominated occupation are relevant to the ACT economy.
- You hold the relevant Australian registration or licencing if it is required for your nominated occupation.
- ACT employability: You have researched the ACT labour market and you are satisfied that you are employable in Canberra, and your skillset and experience are relevant to the ACT economy. Please note, you may not be eligible to apply for positions within the Australian Government due to citizenship / security clearance requirements.
- You must attach an employment statement explaining the research undertaken and confirming that you are employable in Canberra.
- English: You meet the Department of Home Affairs requirement for ‘proficient’ or ‘superior’ English; or you hold a valid passport issued by the United Kingdom, the United States of America, Canada, New Zealand or the Republic of Ireland.
- Spouse / partner: If you wish to claim Matrix points:
- for a spouse / partner, you must have proof of the relationship; either a marriage certificate or civil partnership/union certificate. The ACT does not accept a claim for defacto.
- in the spouse / partner employment category, your spouse / partner must meet the Department of Home Affairs requirement for ‘competent’ English; or hold an Australian passport.
- Overseas Resident: You and any migrating dependents (except children enrolled at school in the ACT):
- are living overseas.
- have not lived in Australia for the last 12 months.
- do not hold a current Australian visa (or bridging visa), except an Australian visitor visa.

Schedule 1
To be considered for an invitation to apply for the State nomination General stream, candidates must:
- have an occupation listed as available and eligible for the intended visa subclass on the WASMOL – Schedule 1;
- at least one year of Australian work experience in the nominated (or closely related5) occupation over the last 10 years; or at least three years of overseas work experience in the nominated (or closely related) occupation over the last 10 years;
- meet the following minimum English language requirements:
- an English language level of ‘proficient’ must be obtained by candidates nominating an ANZSCO Major Occupation Group 1 (Managers) or Group 2 (Professionals) occupation; or
- for all other eligible occupations an English language level of ‘competent’6 must be obtained;
- English language ability must be demonstrated by achieving the minimum English test scores in all four components in a single test as set out under English language test minimum required scores in Tables 3a and 3b below;
- candidates who hold a passport from the United Kingdom, the Republic of Ireland, the United States, Canada and New Zealand are considered to have met the minimum English language requirements and are exempt from undertaking an English proficiency test;
- have a contract of employment for full time employment for at least 12 months in the nominated or closely related occupation in Western Australia.
Schedule 2
To be considered for an invitation to apply for the State nomination General stream, candidates must:

Graduate stream
To be considered for an invitation to apply for the State nomination Graduate stream candidates must:
- have an occupation listed as available and eligible for the intended visa subclass on the Graduate Occupation List (GOL);
- have gained a Certificate III or higher qualification in Western Australia, including a requirement to have completed at least two years of full time study in Western Australia at a Western Australian university, higher education provider, TAFE, registered training provider or English language provider;
- demonstrate:
- at least six months of paid Australian work experience in the nominated (or closely related) occupation over the past five years. Applicants must enter work experience evidence in their SkillSelect Expression of Interest; or
- a contract of employment9 for full time employment10 in Western Australia for at least six months in the nominated (or closely related) occupation.
- meet the following minimum English language requirements:
- an English language level of ‘proficient’ must be obtained by candidates nominating an ANZSCO Major Occupation Group 1 (Managers) or Group 2 (Professionals) occupation; or
- for all other eligible occupations an English language level of ‘competent’6 must be obtained;

Please note the following general information:
- if you or any of your migrating dependants are currently living interstate, you will not be eligible for the Northern Territory (NT) nomination
- if you or any of your migrating dependants are currently on a student visa and have not completed studies in an NT institution, you will not be eligible for NT nomination
- if you have already been nominated for a subclass 489 or 491 visa by the NT, you will not be eligible for a subclass 190 nomination.
Additional requirements for onshore applicants
Eligible NT Graduates
International student graduates who have studied in the NT will be eligible for a subclass 190 nomination if you have met the following criteria before applying for nomination:
- successfully completed one or more qualifications after studying in the NT, at an NT-based institution for two years in a single tertiary course or a set of nested tertiary courses, and
- lived in the NT for a period of at least six continuous months immediately after the date of completion* of your last qualification, while holding a visa that has no work limitations (graduates will be required to apply for a subclass 485 Temporary Graduate visa to enable this); the time spent on a bridging visa associated with a subclass 485 visa application can be counted in the six month period, and
- demonstrated genuine and sustained efforts to obtain employment** from an NT employer in your nominated occupation or a closely related skilled occupation.
International student graduates who are unable to live in the NT for six months after completing two years of study in the NT will only be considered for a subclass 491 nomination. You must provide evidence of making genuine efforts to obtain employment** from an NT employer in their nominated occupation or a closely related skilled occupation.
You will be expected to demonstrate genuine efforts and progress towards being employed in the NT in your nominated occupation both during and after your studies. These applications will be considered on a case-by-case basis.
* Date of completion is the date on which you were notified that you have met all academic course requirements. This is the date when the final exam results or notice of course completion were available or published.
** Genuine and sustained efforts to obtain employment can be demonstrated through evidence of a number of applications made over a period of time for jobs in relevant occupations in the NT, and other supporting evidence such as membership in relevant professional associations, or positive feedback from industry contacts in the NT.
Other NT Residents
An NT resident applicant includes those on temporary visas with work rights, currently residing in the NT.
NT resident applicants will be eligible for a subclass 190 nomination if you:
- demonstrate that you have been residing in the NT for at least two consecutive years immediately prior to application
- demonstrate that none of your migrating dependants are residing in another part of Australia, and
- demonstrate full-time employment in the NT in an eligible occupation continuously for at least two years immediately prior to applying for NT nomination and demonstrate the employment is available for at least a further 12 months.
NT resident applicants will be considered for a subclass 491 nomination if you meet the following requirements:
- applicants who started living in the NT prior to 1 July 2020, must:
- demonstrate that you have been residing in the NT for at least six consecutive months immediately prior to application
- demonstrate that none of your migrating dependants are residing in another part of Australia, and
- demonstrate full-time employment in the NT in an eligible occupation for at least six consecutive months immediately prior to applying for NT nomination and demonstrate the employment is available for at least a further 12 months.
- applicants who start living in the NT on or after 1 July 2020, must:
- demonstrate that you have been residing in the NT for at least 12 consecutive months
- demonstrate that none of your migrating dependants are residing in another part of Australia, and
- demonstrate full-time employment in the NT in an eligible occupation for at least six consecutive months immediately prior to applying for NT nomination and demonstrate that the employment is available for at least a further 12 months.
An eligible occupation for this purpose is:
- the occupation identified in the skills assessment (nominated occupation), or
- an occupation that is related to the nominated occupation. In order to be related to the nominated occupation, the majority of time in the position must be spent on tasks that align with the skills and knowledge required to undertake the nominated occupation.
The employment must also meet the following additional requirements:
- the position must be based in the NT, and the employer must have a record of trading in the NT for at least 12 months
- positions that are based at serviced office spaces or involve hot-desking arrangements will generally not be considered favourably
- you must be paid at market salary.
Applicants who have not been employed in an eligible occupation will generally not qualify for NT nomination.
Applicants who have been employed on a full-time basis for at least six consecutive months in an occupation that is not an eligible occupation may qualify for a subclass 491 nomination on an exceptional and case by case basis if you are able to demonstrate the following:
- the employer has made genuine efforts to recruit locally and the position cannot be filled by an Australian citizen or permanent resident – at a minimum, evidence should include copies of advertisements placed, and a statement from the employer detailing the number of applicants and reasons as to why no Australian citizens or permanent residents have not been recruited
- there is a genuine need for the position in the business – at a minimum, evidence should include a detailed statement from the employer explaining the need for the position and how the vacancy arose
- you have made genuine and sustained efforts to obtain employment in your nominated occupation or a related occupation in the NT – at a minimum, evidence must include copies / screenshots of applications made for relevant jobs and any feedback received.
Applicants who are on a Temporary Work (Skilled)(subclass 457) or Temporary Skill Shortage visa (subclass 482) must provide a letter of support from your current subclass 457 or subclass 482 sponsoring business stating that they:
- support your visa application
- understand that you will not be tied to their business once the subclass 491 / subclass 190 visa is granted.
The NT Government may contact your employer. There may be circumstances where the need for support from your current employer can be waived.
The Northern Territory General Skilled Migration program is currently closed to offshore applicants.
The Northern Territory Migration Occupation List (NTMOL) provides an indication as to which of the eligible skilled occupations are in demand in the NT. Offshore applicants must read the NTMOL to determine their eligibility.
The program is an initiative owned by the Paspalis Group and supported by the Northern Territory (NT) Government. The program assists overseas nationals obtain NT Government nomination if they meet the following:
- show commitment to supporting the NT’s innovation ecosystem, and
- meet the nomination criteria set by the NT Government.
The program seeks to:
- raise start-up capital for the NT innovation ecosystem
- leverage visa programs managed by NT Government
- maintain the integrity of the NT Government nomination programs
- support genuine applicants who will benefit the NT in areas such as venture capital, population increase, filling skills shortages and business activities
- ensure that local Northern Territorians are not disadvantaged.
To be eligible for NT Government nomination through the MINT program, you must meet all of the following criteria:
Common criteria, you must:
- prove you will live in the Northern Territory and meet the standard genuine intention criteria
- prove you have a clear understanding of the criteria and their obligations
- have enough funds for your own settlement
- provide fulsome and accurate applications
- disclose all relevant information
- have no links to other regions of Australia, unless you also have strong links to the NT
- if you do not have strong links to the NT you may only be eligible for a provisional visa
- not be an international student, unless you have strong links to the NT
- submit nomination applications within two months of signing an agreement with Paspalis Group.
Skilled migration specific criteria, you must:
- meet Australian Government threshold criteria for the relevant visa, read more about migration for work
- apply for an occupation on the Northern Territory Skilled Occupation Priority List and the relevant Australian Government occupation list.
Business migration specific criteria, you must:
- meet Australian Government threshold criteria for the relevant visa, read more about migration for business
- have undertaken your own business research
- propose and commit to undertake a business / investment activity in the NT. The activity must be in-line with the visa stream you are applying for. This may include being a qualifying business, and satisfying the benefit to the NT criteria.
