Under the new legislative instrument,
The new category of persons have been specified as follows: Commencing on 1 July 2022—a person who: (a) has been in Australia for at least 12 months between 1 February 2020 and 14 December 2021; and (b) at the time of application, is employed by a person actively and lawfully operating a business in Australia. This category of persons can access a number of benefits in accessing 186TRT permanent visa, includes:
- The short term stream nominated occupation can still access 186TRT permanent visa (Reg .5.19 (5)(a)(iii) )
- The caveat that is applicable to the nominated occupation will be waived under (Reg .5.19 (8)(b) )
- The required period of time will be reduced by the Covid-19 reduced work period as well as Covid-19 unpaid leave period as defined in the instrument
